Tenant Changes Apartments

Landlord asked the DHCR whether tenant's new apartment was covered under rent stabilization. Tenant had moved from a rent-stabilized apartment during building renovations, and remained in the new apartment after the work was completed. The DHCR told landlord that the new apartment must be rent-stabilized because the exchange partially benefitted landlord, allowing it to complete the renovations. The new apartment wouldn't be covered if the exchange had been solely for tenant's benefit.
