Tenant Can't Be Excused from Pretrial Questioning
LVT Number: 14654
(Decision submitted by Jennifer Ecker of the Manhattan law firm of Kucker & Bruh, LLP, attorneys for the landlord.) Landlord sued to evict tenant. Landlord asked the court for permission to conduct pretrial questioning of tenant. The court ruled for landlord. Tenant later asked to be excused from appearing for pretrial questioning. The court ruled against tenant. The prior ruling already directed tenant to appear, and questioning of medical witnesses indicated no condition that would prevent tenant from understanding or answering questions.
