Tenant Brought Multiple Groundless Lawsuits Against Landlord

Landlord sued permanent tenant, claiming abuse of process and sought a permanent injunction barring tenant from filing any further proceedings or motions without prior court approval and unless tenant was represented by an attorney. Tenant had filed over 20 lawsuits against landlord in 2009, claiming violations of the implied warranty of habitability. Each of the cases was dismissed based on tenant’s default or because it had no merit. Still tenant continued to file lawsuits against landlord. The court ruled for landlord, barring tenant from filing further lawsuits without approval of the court’s administrative judge. There was overwhelming proof that tenant used the judicial system to aggravate landlord and committed abuse of process.
