Tenant Acknowledged That Repairs Were Made

Landlord filed an application to restore tenant's rent. The rent had been previously reduced by the DRA, based on a reduction in services. An inspection showed water stains, falling plaster, and a large hole in the shower stall ceiling. There were also dirt stains and spaces between slats on the living room wood floor. The DRA denied landlord's application to restore rent. Landlord appealed, pointing out that tenant had signed off on landlord's rent restoration application and had acknowledged in prior compliance proceedings that the repairs had been made. The DHCR ruled for landlord. Tenant didn't dispute that he'd signed the consent portion of the rent restoration application. Usually, under those circumstances, rent is restored without an additional inspection. There was no reason shown in this case for going against normal processing procedures.
