Temporary Housing Cubicles Exempt Under HPD Agreement

The DRA ruled that temporary housing cubicles in landlord's building were subject to rent stabilization after substantial rehabilitation of the building. Landlord appealed, claiming that the DRA's order was inaccurate. The DHCR ruled for landlord. Landlord signed a regulatory agreement with HPD in 2006. The cubicles were intended as temporary housing and therefore weren't subject to rent stabilization.

The cubicles were intended as temporary housing and therefore weren't subject to rent stabilization. Under the terms of the agreement with HPD, if landlord later converts the units to permanent housing, they would become rent stabilized even though landlord had substantially rehabilitated the building.
