SRO Building Covered

Landlord asked the DRA for a ruling that its building wasn't subject to rent stabilization. Landlord claimed that the building was converted from a Class B, SRO-type multiple dwelling to a Class A multiple dwelling before the applicable base date. The DRA ruled against landlord. Landlord appealed and lost. Landlord didn't show how the building was used on the July 1, 1974, base date. Prior to 1980, when four separate electric meters were installed, the building had one meter. This indicated that the building was used as an SRO on the base date and so was subject to rent stabilization.

The Certificate of Occupancy for the building showed that, as of 1957, there was one Class A apartment in the building and 13 Class B SRO units. DOB records still referred to the building as an SRO and required landlord to apply for a Certificate of Non-Harassment before making any alterations.
