Landlord sued to evict rent-stabilized tenant for creating a nuisance due to criminal activity. NYPD had searched the apartment with a warrant and found heroin, drug paraphernalia, and a handgun with ammunition. They arrested tenant’s son. The court granted tenant’s request to dismiss the case. Landlord’s termination notice didn’t set forth sufficient details of the claimed illegal activity, and didn’t show that tenant knew or should have known of illegal activity in the apartment. A single incident of illegal drugs in the apartment wasn’t enough. Among other things, landlord’s notice didn’t state where weapons or drugs were found and didn’t mention tenant’s involvement.
