Tenant appealed an HPD decision to terminate his Section 8 housing subsidy. The court ruled against tenant. HPD’s ruling was supported by substantial hearing evidence showing that tenant violated HPD’s policy requiring truthful and complete reporting of family composition on the initial application and recertification forms. The penalty wasn’t disproportionate to the offense or shocking to one’s sense of fairness.
