Tenant filed a fair market rent appeal. Tenant challenged landlord's claimed apartment improvements. The DRA ruled against tenant and dismissed her complaint. The DRA found that the rent landlord charged was less than the fair market rent. Tenant appealed and lost. Landlord showed that the scraping, plastering, and painting was done in connection with electrical and plumbing work in the apartment. So landlord was entitled to a rent increase for the cost of this work.
