Schizophrenic Tenant Evicted
LVT Number: 6978
Landlord sued to evict tenant for creating a nuisance. The trial court ruled for landlord, and tenant appealed. The appeals court affirmed the ruling for landlord. Five tenants testified at trial, detailing repeated instances of tenant's antisocial and abusive behavior. Tenant's psychiatrist described tenant as schizophrenic and stated that tenant was prone to outbursts, although he didn't think tenant was violent. The fact that tenant's conduct may be ``unintentional'' given her illness didn't outweigh the fact that her pattern of threatening other tenants in public areas of the building created a nuisance.
