Replacement Refrigerator Smaller Than Original

Tenant complained of a reduction in services because landlord replaced a defective refrigerator with a smaller one. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that the new unit was comparable in size to the old one. The DHCR ruled against landlord. When DHCR inspected tenant's apartment, both refrigerators were there. The old refrigerator had a capacity of 16 cubic feet. The replacement had only 10 cubic feet. The new refrigerator wasn't comparable in size to the defective one.
