Landlord appealed, claiming that he didn't realize the basement windows weren't replaced when the prior window installation was done. The DHCR ruled against landlord. The basement windows were done over a nine-year period, didn't make up at least 80 percent of the building's windows, and weren't hallway or lot line windows that can qualify separately as an MCI.
