Replacement of Basement Windows

Landlord applied for MCI rent hikes based on the replacement of basement windows. The DRA ruled against landlord because the installation was done piecemeal. Landlord appealed, claiming that he didn't realize the basement windows weren't replaced when the prior window installation was done. The DHCR ruled against landlord. The basement windows were done over a nine-year period, didn't make up at least 80 percent of the building's windows, and weren't hallway or lot line windows that can qualify separately as an MCI.
