Repaving of Parking Area Included in Increase

Landlord applied for MCI rent increases based on the installation of walkways in and around the building complex, along with other related work. The DRA ruled for landlord in large part, but disallowed any increase for the repaving of the parking areas. Landlord appealed and won. All the walkways around the building had been replaced, as well as the entryway, steps, driveway and parking areas. Since the parking area repaving had been done in connection with MCI work, it qualified as an MCI.
