Rents Reduced for Broken Elevator

Tenants complained of a reduction in building-wide services due to a non-functioning elevator. The DRA ruled for tenants and reduced their rents. Landlord appealed and lost. Landlord argued that the elevator was being replace and that there were two other working elevators in the building at that time. But at DHCR inspection, the elevator on the right side of the building wasn’t working and electrical service to that elevator was disconnected. While there were two other working elevators, there was no indication of ongoing work to the broken elevator. The DRA properly reduced tenant’s rents.
