Rent-Stabilized Tenant's Son Gets Apartment
LVT Number: #26055
Rent-stabilized tenant's son claimed succession rights and complained that landlord refused to give him a renewal lease in his name. The DRA ruled against the son, who appealed and won. Tenant moved out of the apartment on Jan. 2, 2013. The son submitted 2011 bank statements and utility bills connecting him to tenant's apartment since 2008. Tenant also showed he paid the utility bills between 2012 and 2014. The son also showed that he was disabled by submitting Social Security documentation showing his disability status. Because of his disability, the son had to prove only that he had lived with tenant for one year before she moved out permanently. The son proved succession rights and therefore was entitled to a renewal lease.
