Rent-Stabilized Tenant's Monthly Rent Reduced to $1 Following DOB Vacate Order

Rent-stabilized tenant applied for a rent reduction based on decreased services after a fire cause him to involuntarily vacate his apartment on Jan. 16, 2024. The DRA ruled for tenant and reduced his rent to $1 per month while the apartment remained uninhabitable. At the time of the ruling, a DOB Vacate Order was still active. Landlord appealed and lost. Landlord argued that tenant's apartment wasn't listed in the Vacate Order and wasn't affected by the fire.

The DRA ruled for tenant and reduced his rent to $1 per month while the apartment remained uninhabitable. At the time of the ruling, a DOB Vacate Order was still active. Landlord appealed and lost. Landlord argued that tenant's apartment wasn't listed in the Vacate Order and wasn't affected by the fire. But landlord had acknowledged the fire in answer to tenant's complaint, and the DOB Vacate Order and violation did list tenant's apartment number.
