Rent-Stabilized Apartment Was Vacancy Deregulated in 2010

Tenants complained of rent overcharge and improper apartment deregulation, noting that landlord charged $2,875 per month in June 2017. In response, landlord submitted copies of leases dating back to August 2010. The DRA ruled against tenants, finding no overcharge and no colorable claim of fraud in connection with the apartment deregulation. The DRA found that the base rent date for tenant's complaint was June 28, 2011, four years before tenant filed the complaint. Landlord was entitled to deregulate the apartment in 2010 when the rent was $2,000 or more.
