Rent Restoration Date Changed

Tenant complained of a reduction in services. The DRA ruled for tenant and reduced her rent. Landlord later applied for rent restoration, claiming that services had been restored. The DRA ruled for landlord and restored tenant's rent to its prior level effective Jan. 1, 2007. Tenant appealed, claiming that the rent restoration date should be June 1, 2007, not Jan. 1, because landlord didn't properly install a bathtub until May 24. The DHCR ruled for tenant. The DHCR inspection reports stated that as of April 5, 2007, bathtub repairs were still in progress.

Because tenant stated that the repairs were completed in May, the effective date of the rent restoration would be June 1 rather than the later first rent payment date after inspection confirmed that repairs were completed.
