Rent History Records Show Apartment Was Deregulated in 2013

Tenant complained of rent overcharge and improper apartment deregulation. The DRA denied the overcharge claim but ruled that the apartment couldn't be deregulated, despite landlord's claim. Landlord appealed and won. Landlord submitted sufficient proof of claimed individual apartment improvements (IAIs). As a result, prior tenant's Aug. 1, 2013, legal vacancy rent exceeded $2,500 per month and the apartment was deregulated. That tenant's DHCR lease rider explained the rent calculations.

And, even if somehow that tenant remained subject to rent stabilization, when complaining tenant moved in, the rent was properly deregulated. The fact that landlord charged tenant $1,800 per month wasn't a waiver, and tenant was deregulated.
