Rent Hike Granted for New Lobby/Hallway Floor Tiling

Landlord applied for MCI rent hikes based on installation of new floor tiles in the lobby and in all of the hallways. The DRA ruled for landlord. Tenants appealed and lost. A complete replacement of a building’s public area flooring, as done here, constitutes an MCI. Tenants also questioned whether the useful life of the old floor tiling had expired. But, since this was the first time that landlord sought MCI rent increases for floor tiling, it didn’t matter whether the useful life of the old flooring had expired.
