Rent Demand Didn't Break Down Amount Owed

LVT Number: 10275

(Decision submitted by William J. Gribben of the Manhattan law firm of Himmelstein, McConnell & Gribben, attorneys for the tenant.) Landlord sued to evict co-op tenant for nonpayment of rent. Tenant claimed landlord's rent demand notice was defective because it didn't break down the claimed amount owed or specify the time period for which the back rent was due. The notice also included amounts other than rent in the total sum demanded. The court ruled for tenant and dismissed the case. Landlord didn't break down by month the aggregate maintenance charges supposedly due.
