Rent-Controlled Tenant's Son Can't Get Apartment

The son of a rent-controlled tenant applied to the DHCR in 2023 for a determination that he had succession rights to the apartment after tenant moved out in 2022. The DRA ruled against the son, who appealed and lost. The son claimed that he had lived in the apartment since 1968. But in a housing court eviction proceeding, the court had already ruled in August 2023 that the son didn't have succession rights. The DHCR had no authority to rule against the court decision. In addition, the DRA correctly found that the son submitted insufficient documentation of his succession claim. He gave the DRA only a copy of his 1987 tax return, a certificate of insurance, letters, and a copy of his 1991 driver's license. The son didn't prove that he had lived in the apartment for two years before tenant moved out.
