Recyclables Placed Out for Collection in Wrong Type of Container

DOS issued a violation notice to landlord for placing recyclables out for collection in an improper curbside container. Landlord objected, claiming that its long-term building super placed the glass and plastic bottles out for collection in a clear plastic bag and was fully aware of the lawful procedures for recycling. The ALJ ruled against landlord and fined it $100. Landlord appealed and lost. The DOS inspector found that the glass and plastic were placed at curbside in a black plastic bag.
