Recyclables Mixed with Nonrecyclables

The DOS issued a violation notice to landlord for mixing recyclables with nonrecyclables in trash placed out for collection. Landlord objected, claiming that tenants mixed household debris in with the recyclables. The ALJ ruled against landlord and fined it $25. Landlord appealed and lost. DOS was reasonable in assuming that the trash got mixed together before being placed out for collection. It was landlord's responsibility to separate it.
