Landlord applied for MCI rent increases based on the installation of a courtyard and walkways. The DRA ruled against landlord, finding that the work was repair and maintenance work only. Landlord appealed and lost. Landlord only resurfaced concrete in an existing rear courtyard. This was repair work, not a major capital improvement.
