Prior Tenant Got SCRIE Benefits

Tenant complained of a rent overcharge. The DRA ruled against tenant. Tenant appealed, claiming that prior tenant paid a much lower rent than she did. The DHCR ruled against tenant. Prior tenant received SCRIE benefits. She paid only a portion of her rent, while the city paid the balance. So prior tenant's actual rent payment was less than the legal rent. Landlord was entitled to charge tenant the full legal rent, and there was no overcharge.
