Prior Order Found No Overcharge

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed, pointing out that in a prior order concerning the same tenant, the DRA had found no overcharge. The DHCR ruled for landlord and revoked the overcharge finding. Both rent overcharge complaints concerned the same time periods and contained the same facts. Tenant never appealed the prior DRA order.
