Pre-Existing Illegal Conversion Is Violation

DOB issued a violation notice for illegal alteration of a one-family house to an illegal two-family house. Landlord claimed that the alteration was done before she bought the building and that only her family members lived in the house. The ALJ believed landlord but still fined her $3,050. Landlord appealed and lost. It didn't matter that the conversion was done before landlord bought the building; she was responsible for maintaining the illegally altered building.
