Plumbing Work Done Without Permit

DOB issued a violation notice to landlord for performing plumbing work at the building without a permit. Although landlord had a plumbing permit to do work in the basement and on the first floor, the violation cited plumbing work being done in 14 apartments above the first floor. The inspector testified that he saw changes in gas piping in apartments throughout the building and some of the work was left unfinished. He also saw risers, piping material, and clips to the ceilings in the apartments. The inspector also submitted photographs. A plumber who testified for landlord said that the only work he did was repair of a gas leak in one apartment. The ALJ ruled for landlord and dismissed the violation. DOB appealed and won. ECB fined landlord $800. The fact that the inspector couldn't say which apartments his photographs were taken in didn't invalidate his testimony. Landlord offered no proof concerning conditions in any of the apartments.
