Plumbing Work Doesn't Qualify

Landlord applied for MCI rent hikes based on sewer main and water main replacement. The DRA ruled against landlord because the work didn't qualify as an MCI. Landlord appealed and lost. Installation of sewer lines or water main service line doesn't qualify as an MCI unless done in connection with a complete qualifying building-wide plumbing installation that includes hot and/or cold water risers, and returns and branches to the fixtures in each apartment.

Installation of sewer lines or water main service line doesn't qualify as an MCI unless done in connection with a complete qualifying building-wide plumbing installation that includes hot and/or cold water risers, and returns and branches to the fixtures in each apartment. Landlord installed only a new water main with tap and main valve, and a new water meter and waterline into the meter room and sewer main. So landlord's work didn't qualify as an MCI.
