Parking Space Is Essential Service

Tenant complained of a rent overcharge when landlord raised his parking garage rent above the amount permitted by the applicable rent guidelines. Landlord claimed that the garage rent wasn't tied to the apartment. The DRA ruled for tenant, and landlord appealed. The DHCR ruled against landlord. Tenant had used the service of the garage space since he'd first rented the apartment. And landlord listed the garage space as a service in its initial 1984 rent registration. The garage space was an essential service subject to rent guidelines.
