Painting in Progress at Time of Inspection

Tenant complained of a reduction in services based on reduced janitorial services at the building. The DRA ruled against tenant and dismissed the complaint. Tenant appealed, claiming that the painting of the building that was in progress at the time of the DHCR's inspection hadn't been completed and that floor numbers and door numbers hadn't been replaced. The DHCR ruled against tenant. The DHCR's inspection showed that janitorial services were being maintained building wide.

Since painting of the lobby, hallways, and stairways was in progress at the time of the inspection, no relief was warranted. Tenant could file a new complaint after the painting was completed if any conditions qualified as a reduction in services.
