Ornamental Steel Fence Qualifies as MCI

Landlord applied for MCI rent hikes based on concrete replacement and engineering services connected with the work. The DRA ruled for landlord. Tenants appealed, claiming that the replacement of an ornamental steel fence included in the work didn't qualify as an MCI. The DHCR ruled against tenants. The steel fence was necessary work done in connection with the concrete courtyard installation at the south and west facade/areaways of the building. Therefore, this work qualified for an MCI rent hike.
