Occupant Lived with Tenant 33 Years

Occupant asked the DHCR to grant her pass-on rights to a rent-controlled apartment. The DRA ruled for occupant. Landlord appealed and lost. Occupant submitted copies of tax records showing that he had lived in the apartment since 1975. He also submitted a Certificate of Domestic Partnership, tenant's will naming occupant as beneficiary, tax returns, proof of a joint bank account dating back to 1984, and a letter from a building neighbor describing tenant's relationship with occupant. Landlord presented no proof that occupant had lived anywhere other than the apartment during the last two years before tenant died.
