Not-for-Profit Co-op Not Subject to Rent Stabilization

Tenant complained that landlord failed to maintain hot water. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that tenant's apartment wasn't subject to rent stabilization. The DHCR ruled for landlord and revoked the DHCR's ruling. Tenant's apartment was located in a cooperative owned by 2333 Grand Avenue Housing Development Finance Corporation. This was a not-for-profit cooperative corporation. Tenant owned shares to the co-op apartment. Also, tenant had lived in the building since 1992, when it was owned by the City of New York.
