No Rent Overcharge Where Missing Registration Filed

Successor tenant complained of rent overcharge. He pointed out that landlord hadn’t registered his apartment between 2001 and 2013. The DRA ruled against tenant, who appealed and lost. Landlord filed the missing rent registrations while tenant’s complaint was pending before the DRA. Under Rent Stabilization Code Section 2528.4, upon service and filing of a late registration there will be no finding of rent overcharge. Tenant’s complaint was properly dismissed.
