No Rent Hike for Cost of Repairs

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord claimed that it was entitled to a rent increase for apartment improvements. Landlord submitted three bills showing repairs made to steam pipes, lights, and a stove. The DHCR ruled for tenant. Under the rent stabilization code, work considered to be ordinary maintenance or repair doesn't qualify for a 1/40th rent increase.
