No Renewal Lease Required After Tenant Agrees to Relocate

Rent-stabilized tenant complained that landlord failed to offer her a renewal lease. The DRA ruled for tenant and ordered landlord to send the renewal. Landlord appealed and won. Landlord showed the DHCR that tenant had signed an Apartment Relocation Agreement, a Surrender Affidavit, and a new lease for the new apartment. Landlord no longer had an obligation to offer tenant a renewal lease for her old apartment.
