Tenant complained of a rent overcharge. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that the overcharge finding was in error. The DHCR ruled for landlord and revoked the overcharge ruling. The DRA provided no explanation for its decision. Landlord could have a vacancy allowance and guidelines increases disallowed by the DRA. And since the complaint was filed after July 1, 1991, any failure by landlord to register the apartment shouldn't have resulted in an overcharge finding.
