No Proof that Fuel Cost Report Filed with DHCR

The DRA suspended landlord's fuel cost adjustments for 2003 based on a finding that landlord didn't file a timely 2003 report of a decrease in fuel price for gas. Landlord appealed, claiming that she submitted a timely fuel cost report. The DHCR ruled against landlord. While landlord apparently sent a copy of the report to tenant, there was no proof that landlord filed the report with the DHCR.
