No Penalty for Landlord Who Corrected Wall Crack

DOB issued a violation notice to landlord for failing to maintain an exterior building facade. DOB’s inspector stated that there were several cracks at various locations of the building walls. At a hearing, landlord presented a Certificate of Correction dated Feb. 9, 2016. The cure date provided in the violation was Feb. 22. The ALJ ruled against landlord and imposed a reduced fine of $1,000. Landlord appealed and won. Landlord claimed that, since it cured the violating condition before the cure date listed in the violation notice, no penalty should be imposed. ECB agreed, and revoked the fine.
