Tenant sued landlord for negligence, claiming that his children suffered from lead poisoning from exposure to lead paint in their apartment. Landlord asked the court to dismiss the case without a trial. The court ruled for landlord. Tenant appealed and lost. Landlord wasn't notified of any lead paint hazard in tenant's apartment prior to 1995 when the condition was discovered by the Westchester County Department of Health.
