No MCI Increase for Terrace Doors

Landlord applied for MCI rent hikes based on the installation of new terrace doors. The DRA ruled against landlord, who appealed and lost. Landlord claimed that it replaced all the terrace/balcony doors in the building and that, in a prior opinion, the DHCR stated that this work qualified as an MCI. But the prior opinion landlord relied on was issued in connection with sliding glass doors at a different building.

Landlord claimed that it replaced all the terrace/balcony doors in the building and that, in a prior opinion, the DHCR stated that this work qualified as an MCI. But the prior opinion landlord relied on was issued in connection with sliding glass doors at a different building. When landlord asked the DHCR for a prior opinion about the terrace doors in question, the DHCR advised landlord that these doors wouldn't qualify as an MCI unless installed in connection with a qualifying MCI.
