No Equipment Permit for Roof Air Conditioner

DOB issued a violation notice to landlord for having an air conditioner on the first-floor rear roof of the building without an equipment use permit. Landlord claimed that the unit was installed by prior landlord and was never in use since he owned the building. The ALJ ruled for landlord. DOB appealed and won. New York City law requires an equipment use permit for the roof air conditioner. It's not a valid defense to claim that prior landlord installed the air conditioner. Landlord was fined $400.
