No Defect Found in Tenant's Windows

Landlord applied for MCI rent hikes based on the installation of new apartment windows. The DRA ruled for landlord but exempted one tenant from the rent increase based on window defects. The DRA's decision was based on photographs submitted by tenant. Landlord appealed, claiming that the windows weren't defective. The DHCR ruled for landlord and restored the MCI rent hike for tenant. The DHCR sent its own inspector to tenant's apartment in response to landlord's PAR. The inspector found that the windows were properly caulked and that the installation was done in a workmanlike manner.
