No Basis for Tenant's Fraud Claim

Rent-stabilized tenant complained of a rent overcharge. The DRA ruled against tenant, finding no overcharge. Tenant appealed and lost. Tenant claimed fraud and asked the DHCR to review rent history records predating the base date. Tenant paid $350 per month on the base date, four years before his complaint was filed. Prior landlord later reduced tenant's monthly rent to $280. But nothing in this case pointed to any other violations of the Rent Stabilization Law, a fraudulent deregulation scheme, or a variance in the rent registration history.
