Landlord applied for MCI rent hikes based on the installation of new windows. The DRA ruled for landlord. Tenants appealed, claiming that the application wasn't completed on time and that the windows were defective. The DHCR ruled against tenants. Tenants hadn't raised the issue of on-time filing previously and couldn't do so now. And there was no proof that the window installation was defective. An inspection showed there were problems opening only two windows, and the tenants of those apartments were exempted from the rent increases.
