New Tenant Denied Access

Landlord applied to restore the rent based on a restoration of reduced services. Tenant didn't sign landlord's application, so the DHCR ordered an inspection. The DHCR's inspector couldn't get access to the apartment, so the DRA denied landlord's application. Landlord appealed, claiming that complaining tenant had moved out and new tenant wouldn't cooperate and allow the inspection. The DHCR granted landlord's application. Landlord shouldn't be penalized for new tenant's refusal to permit an inspection, and there was other proof that complaining tenant had signed off on the repairs.
