Landlord applied for MCI rent hikes based on the installation of a new heating oil storage tank. The DRA ruled for landlord. Tenants appealed, claiming that landlord didn't get the proper permits for the storage tank. The DHCR ruled against tenants. Even though landlord got approvals in an unusual order, it got all the required permits before the DRA issued its order approving the MCI increases.
