MCI Rent Hike Granted for New Boiler and Burner

The DRA granted landlord's application for MCI rent hikes based on repiping, as well as installation of a new boiler and burner.  Tenants appealed and lost. They claimed that the useful life of the old boiler and burner hadn't expired, that the repiping wasn't building-wide, and that existing gas ranges weren't replaced. But DOB had signed off on the building-wide repiping and no MCI increase was sought for the replacement of gas ranges. Since no prior MCI increase had been granted for a boiler or burner, the useful life of the prior equipment wasn't an issue.
